Terms and Conditions of Website Use and Service

 

This document constitutes a legally binding agreement (the "Agreement") between the User and Eco Generation LLC. Please read these Terms and Conditions carefully before using the website (https://ecogeneration.ge), registering, or ordering products.

Visiting the website, registering an account, or purchasing any product means that you fully and unconditionally agree to these Terms and Conditions.

1. Definition of Terms

  • Company / We / Us – Eco Generation LLC (ID: 405 303 069).
  • User / You – Any physical or legal entity (including commercial enterprises, catering establishments, etc.) that visits the website, registers on it, or purchases products.
  • Website – The online platform owned by the Company, which operates on the basis of Shopify and is available at: https://ecogeneration.ge.
  • Products – Disposable eco-friendly tableware and accessories displayed for sale on the website, including: disposable wooden forks; disposable wooden spoons; disposable wooden knives; disposable ice cream spoons; wooden coffee and beverage stirrers; disposable dessert spoons; wooden skewers; wooden sticks and other wooden accessories; paper straws of various sizes and designs; sugarcane fiber straws; other types of biodegradable and compostable disposable tableware; eco-friendly food packaging materials; disposable eco-friendly serving accessories; and other products and accessories compliant with environmental standards.

2. Website Registration and Personal Account

  • To purchase products from the website, the User must complete the registration process and create a personal account.
  • During registration, the User is obliged to provide real, accurate, and truthful data (first name, last name, personal ID number, phone number, email address, and delivery address). In the event of any changes to this data, the User is obliged to immediately update the information in their personal cabinet.
  • The User is solely responsible for maintaining the confidentiality of their personal account password. Any action performed from the User's profile shall be deemed to have been executed personally by that User.
  • If you suspect that unauthorized access has been gained to your account, you are obliged to immediately notify the Company via email at: info@ecogeneration.ge.

3. Product Ordering, Pricing, and Payment

  • Product prices displayed on the website are indicated in the national currency (Georgian Lari - GEL) and include all taxes provided by the legislation of Georgia (including VAT). The price does not include the cost of the delivery service unless stated otherwise on the website within the framework of a specific promotion.
  • The Company reserves the right to unilaterally change the product assortment, availability, or prices on the website at any time.
  • Payments are processed electronically (cashless) via credit/debit cards through the secure platform of the Company's partner payment provider – "Tpay" LLC (ID: 402291220).
  • An order is considered accepted and confirmed once the User successfully completes the payment process and receives a corresponding confirmation on the website, via email, or on their mobile phone.

4. Delivery Conditions (Courier Service)

  • The delivery of products purchased on the website is carried out by the Company through partner courier and logistics companies (such as Quickshipper LLC (ID: 405547877) and/or other authorized providers).
  • Delivery is executed strictly to the exact address specified by the User during the checkout process.
  • Delivery times and rates depend on the delivery region, the specific address, and the service selected by the customer—specifically, whether the buyer wishes to receive the package urgently (via fast/express delivery) or chooses standard delivery (for example: the next working day or within the following few days). Detailed information regarding the timeframes is provided to the user before completing the order and/or upon order confirmation.
  • Upon delivery, the User is obliged to visually inspect the integrity of the parcel and the quantitative compliance of the products with the order in the presence of the courier.

5. Product Return and Exchange Policy

  • Since Eco Generation LLC sells single-use/disposable products (tableware, accessories, and other items), the return or exchange of products is permitted only if:
    1. The delivered products are damaged, possess a manufacturing defect, or do not match the ordered model/quantity.
    2. The product packaging is completely undamaged, remains in its original condition, and has not been opened (for the purpose of maintaining hygiene standards).
  • In the event that a defect or discrepancy is discovered, the User is obliged to notify the Company within 24 (twenty-four) hours of receipt via email (info@ecogeneration.ge) and submit photographic or video evidence substantiating the defect.
  • In the event of a justified claim, the Company will, at its own expense, ensure the exchange of the product or refund the paid amount to the User within a reasonable timeframe (no later than 14 calendar days).

6. Intellectual Property

  • All materials displayed on the website, including but not limited to: logos, trademarks, texts, graphics, designs, photographs, code, and software, are the exclusive property of Eco Generation LLC and are protected under Georgian and international intellectual property legislation.
  • The User is strictly prohibited from copying, distributing, modifying, publishing, or using the content available on the website for any commercial purpose without the prior written consent of the Company.

7. Limitation of Liability

  • The Company is not responsible for temporary delays, interruptions, or errors in the operation of the website caused by technical faults of the e-commerce platform (Shopify), technical or hosting providers, internet connection failures, or force majeure events (natural disasters, strikes, war, etc.).
  • The Company shall not be held liable for any damages resulting from the User providing incorrect personal, contact, or delivery data.
  • The Company is solely responsible for the quality of the products within their factory packaging. Responsibility for any damages resulting from incorrect or unhygienic storage/use of the products lies entirely with the User.

8. Confidentiality and Personal Data

  • The collection, processing, and storage of the User's personal data are regulated by the "Privacy Policy," which is available on the website and constitutes an integral part of this Agreement.

9. Validity Period and Changes to the Terms

  • These Terms and Conditions shall enter into force as soon as the User begins using the website and shall remain active until the complete termination of the User's account or relationship with the Company.
  • The Company is authorized to unilaterally introduce changes or additions to these Terms and Conditions at any time. Changes become effective immediately upon their publication on the website: https://ecogeneration.ge.
  • Continued use of the website following the publication of changes automatically constitutes the User's consent to the updated Terms and Conditions.

10. Dispute Resolution and Governing Law

  • These Terms and Conditions are governed by and construed in accordance with the active legislation of Georgia.
  • Any misunderstanding or dispute arising between the parties shall be resolved through negotiation. If an agreement cannot be reached, the dispute shall be referred to and resolved by the Common Courts of Georgia, in accordance with the jurisdiction established by law.
